Definitions

“Engineers Without Borders UK”, “we” or “our” means Engineers Without Borders UK, a charity registered in England and Wales (1101849) and Scotland (SC043537). Registered as a company limited by guarantee in England & Wales (04856607). Registered address: The Foundry, 17 Oval Way, London, SE11 5RR, United Kingdom.

“Website” means www.ewb-uk.org, or any other website controlled or owned by Engineers Without Borders UK which links to these terms and conditions.

“Material” means all of the information, data, text, graphics, links or computer code published, contained or available on the Website.

“User”, “you” or “your” means the individual or entity accessing any part of the Website, making a donation, ordering any goods, registering for any events and/or signing up for membership via the Website.

“User Content” means content submitted or uploaded by Users, including text, images, photographs, videoclips, logos, marks and any other information and materials.

Applicable terms and conditions

The Website is owned by Engineers Without Borders UK and any use made of the Website (including registrations and donations and orders for goods made via the Website) is subject to these terms and conditions. Engineers Without Borders UK may, from time to time, modify or revise these terms and conditions by updating the text of this page.

Use of the Website

Anyone may access and view any non-password protected parts of the Website and may use the Material contained therein for their own purposes, provided:

  • it is used for information purposes only, is reproduced for personal use only and is not reproduced for commercial gain or on any other website;

‘Engineers Without Borders UK’, ‘Engineers Without Borders’, ‘EWB’, ‘EWB-UK’ and our logo are UK registered trade marks of Engineers Without Borders UK. You are not permitted to us any of our trade marks without our prior written approval, unless they are part of the Material you are using as permitted in accordance with clause 3 above.

All works in the nature of databases attract database rights.

Engineers Without Borders UK does not control such websites, and is not responsible for their content. Restricted access

Certain areas of the Website are only accessible if you register with us.

By registering, you agree to keep your username and password confidential and not to disclose or share them with anyone.

As a registered User, you may post or upload User Content to the Website as long as you comply with these terms and conditions.

You grant us a perpetual, royalty-free, non-exclusive license to use User Content on the Website. You guarantee that you are the person depicted in any image or video you upload to the Website and that if you upload any image or video of a third person, you have obtained their consent to do so.

We reserve the right to reject, block, suspend or remove User Content at any time at our sole discretion. We do not guarantee that User Content will be displayed on our Website. Any content published is at our discretion.

Posting personal information on our Website means that such information is publicly accessible. We strongly recommend that you do not disclose personal information that could be used to identify you (e.g. your name, date of birth, address etc). Viruses

Whilst Engineers Without Borders UK makes all reasonable attempts to exclude viruses from the Website, we do not guarantee that our Website is secure or free from bugs or viruses and we accept no liability for damage caused through the downloading of viruses. It is recommended that Users take all appropriate safeguards before downloading Material from the Website.

Users must not misuse our Website by knowingly introducing viruses or other material that is malicious or technologically harmful.

Online transactions

Engineers Without Borders UK reserves the right to vary event registration fees and the prices of goods without notice. All event registrations and orders for goods are subject to availability and Engineers Without Borders UK reserves the right to refuse to accept any registration and to refuse to supply any goods to any individual.

Encryption

Engineers Without Borders UK uses Secure Sockets Layer (SSL) protocol in order to provide a secure connection between the Website and the User. This is in keeping with industry standard levels of encryption and evidenced by the SSL certificate held for the Website domain.

Although the Website uses encryption security software where online payment details are accepted, we cannot guarantee the security of information and payments transmitted via the internet. Any loss incurred or sustained by any User who transmits information via e-mail or other internet links shall be borne solely and exclusively by such User. In no event shall any such loss in whole or part be borne by Engineers Without Borders UK.

Force majeure

Engineers Without Borders UK shall not be held to be in breach of its obligations hereunder nor liable to the User for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.

General

If any provisions of these terms and conditions are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected.

These terms and conditions constitute the entire agreement between Engineers Without Borders UK and the User and supersede all other (prior or contemporaneous) communications and proposals, whether electronic or written, between the User and Engineers Without Borders UK.

Any failure of Engineers Without Borders UK to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement of any such rights.

Jurisdiction

These terms and conditions and the use by the User of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these terms and conditions.
